Proposed legislation providing that no child shall be transported to or from any public school without the prior written consent of his parent or legal guardian, and that each child shall be permitted to attend the public school nearest his residence, which has a seat available, would promote and preserve racially segregated schools and would violate the equal protection clause of the Fourteenth Amendment to the Constitution of the United States and arts. 1 and 10 of the Declaration of Rights of the Massachusetts Constitution. [901-909] On July 10, 1973, the Justices submitted the following answers to questions propounded to them by the Governor.
