STEWART, Justice: The Fourth District Court, sitting without a jury, convicted the defendant of speeding in violation of Â§ 41-6-46, Utah Code Ann. (1953), as amended. His trial in the district court was a de novo review, pursuant to Â§ 78-3-5, of his Justice of the peace court conviction. He attacks the constitutionality of Â§ 41-6-46. This Court has jurisdiction of the appeal pursuant to Art. VIII, Â§ 9 of the Utah Constitution. Vernal City v. Critton, Utah, 565 P.2d 408 (1977); Eureka City v. Wilson, 15 Utah 53, 48 P. 41 (1897), affd, 173 U.S. 32 (1899).
